How can you prove workplace sexual harassment?

On Behalf of | Mar 20, 2024 | Sexual Harassment

Workplace sexual harassment can be difficult to prove. For instance, you may claim that you experienced quid pro quo sexual harassment when your boss offered you a promotion in exchange for sexual favors. But your boss may deny that this conversation ever occurred.

So how do you provide concrete evidence? How do you prove that the sexual harassment took place?

Recorded evidence

First of all, you may have records of certain types of evidence. For example, you want to keep email messages, text messages and social media messages. At the very least, screenshot any relevant message from the other party in case they delete those messages.

A record of events

Another important step to take is to make a written record of key events that occurred, including the people who were involved, the behavior that took place, if anyone else witnessed it and where it happened. This can help you keep your story straight.

Speaking of witnesses, it can be very helpful to get witness testimonies or statements regarding the harassment that occurred. If someone else can corroborate your story, it goes a long way toward showing that you are telling the truth.

Video evidence

Not every case is going to have video evidence, depending on where the event took place. But many offices, stores and other professional environments do have security footage. This may help to back up your story, such as showing that you and your boss were together at the time that you claim.

Sexual harassment is not something that any employee should have to face, but it does happen. If it happens to you, then you need to know what legal steps to take.
